Abstract

In this paper, we highlight a topic that we consider to be highly relevant and useful: that of the partner in a commercial company. We consider this topic to be relevant because commercial companies are the driving force behind a market economy. In the following sections, we will explain in a clear, precise, and accessible manner what a commercial company is, how a partner can be excluded, and how a partner can withdraw from a company. We will also analyze, with specific references to certain case studies from relevant Romanian case law, situations involving partners in commercial companies, as well as how the courts have addressed these issues.
