NEW FUNDAMENTAL PRINCIPLES IN CRIMINAL PROCEDURE LAW MATTERS

Abstract


“Upon the birth of the new Criminal Procedure Code, the intention was to establish it on the foundations of new principles which, along with the classical ones, should oblige the judiciary to achieve an independent and impartial criminal justice, able to restore the respect and confidence of the public opinion, as well as that of litigants in the act of justice. 

These new principles are general rules present in the laws of the European Union Member States which underlie the modern criminal trial, rules whose validity and efficiency have been verified by the case law and jurisprudence of the European Court of Human Rights”.
